Terms & Conditions

These terms govern the agreement between ISN Free WiFi and the businesses, ISPs, and venues ("tenants") that run their captive portal on our platform. Last updated 30 July 2026.

Acceptance of these terms

By creating a business account, publishing a captive portal, or otherwise using the ISN Free WiFi platform ("the Platform"), you agree to these Terms & Conditions on behalf of yourself and the organization you represent. If you do not agree, do not create an account or use the Platform.

Definitions

  • Platform — the ISN Free WiFi SaaS product, including the business dashboard, captive portal engine, router management tools, and related APIs.
  • Tenant — the business, ISP, or venue that registers a business account and operates one or more branded captive portals on the Platform.
  • Guest — an end user who connects to WiFi through a tenant's captive portal. Guests are the tenant's customers, not ISN Free WiFi's, and are not party to this agreement.
  • Business Account — the tenant's administrative account used to configure branding, routers, billing, and portal settings.

Eligibility & account registration

You must be authorized to act on behalf of the business, ISP, or venue you are registering, and must provide accurate business, contact, and billing information. You are responsible for keeping your login credentials confidential and for all activity carried out under your Business Account, including actions taken by staff you invite.

Subscription & billing

Standard access to the Platform is billed at a flat monthly fee (R1,500/month by default, unless a different rate has been agreed with your account) with no per-guest or per-router surcharges under the standard plan. Fees are billed in advance for each billing cycle and are non-refundable except where required by law. You are responsible for keeping your payment method current; failed payments trigger the grace period described below.

Suspension for non-payment

If a payment fails, your Business Account enters a 5-day grace period during which your dashboard will flag the account as past due but your captive portal continues to serve guests. If payment is not resolved within that window, portal-facing features (splash pages, voucher issuance, advertising) are suspended until the outstanding balance is settled. Suspension does not delete your configuration, branding, or historical data.

Tenant responsibilities

  • You are responsible for the accuracy of the branding, terms, and content you publish on your own captive portal, and for your own relationship and terms with your Guests.
  • You must comply with all laws applicable to operating public or guest WiFi in your jurisdiction, including any local requirements around guest registration or data retention.
  • You may not use the Platform to distribute unlawful content, run open relays for abuse, or interfere with the security or normal operation of the Platform or other tenants' portals.
  • Router credentials and CLI access granted to your account must not be shared outside your organization; actions taken through router management tools are logged against your account (see Section 7).

Data isolation & security

Each tenant's data — guest records, portal configuration, billing, and analytics — is logically isolated from every other tenant on the Platform and is not accessible to other tenants through the dashboard or API. Actions performed through router management and remote CLI tools are recorded in an audit log tied to the account and IP address that performed them, so that configuration changes can be traced after the fact.

Data protection & POPIA

Where the Platform processes personal information of your Guests (for example, names or ID numbers captured at a captive portal login screen) on your behalf, ISN Free WiFi acts as an operator under the Protection of Personal Information Act (POPIA), and you remain the responsible party for that Guest data. We apply reasonable technical and organizational measures to protect data held on the Platform, and will notify affected tenants without undue delay if we become aware of a security compromise affecting their data.

Service availability

We aim to keep the Platform available at all times and publish live uptime and incident information on our status page. Planned maintenance is scheduled and communicated in advance where practical. Unless a separate service level agreement has been signed with your account, the Platform is provided without a guaranteed uptime commitment.

Intellectual property

ISN Free WiFi retains all rights to the Platform itself, including its software, design, and underlying technology. You retain all rights to the branding, logos, and content you upload for your own captive portal, and grant us a limited license to host and display that content solely to operate your portal.

Termination

You may close your Business Account at any time from the dashboard. We may suspend or terminate a Business Account for material breach of these terms, prolonged non-payment beyond the suspension period, or use of the Platform in a way that puts other tenants or the Platform at risk. On termination, outstanding fees remain due and your data will be retained or deleted in line with our standard data retention practice.

Limitation of liability

To the maximum extent permitted by law, ISN Free WiFi's liability arising from your use of the Platform is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect or consequential loss, including loss of revenue arising from your own guests' use or misuse of your captive portal.

Governing law

These terms are governed by the laws of the Republic of South Africa, and any dispute arising from them is subject to the jurisdiction of the South African courts.

Changes to these terms

We may update these terms from time to time to reflect changes to the Platform or applicable law. Material changes will be communicated to Business Account holders by email or dashboard notice ahead of taking effect. Continued use of the Platform after a change takes effect constitutes acceptance of the updated terms.
