1. Agreement Overview

By purchasing advertising services from ISN Free WiFi ("we," "us," "our"), you ("advertiser," "client," "you") agree to be bound by these Terms and Conditions. This agreement governs the provision of WiFi advertising services on our network.

2. Payment Terms

  • Minimum Spend: All campaigns require a minimum investment of R15,000
  • Payment Schedule: 100% payment required upfront before campaign activation
  • Accepted Methods: Bank transfer (EFT), credit card, or corporate purchase order
  • Currency: All prices quoted in South African Rand (ZAR)
  • Invoicing: Tax invoices issued within 48 hours of payment confirmation
  • Refunds: Non-refundable once campaign goes live (see Cancellation Policy)

3. View Delivery & Guarantees

  • View Definition: A "view" is counted when an ad plays for minimum 80% duration or 15 seconds (whichever is shorter)
  • Delivery Timeline: Views delivered within campaign duration specified in package
  • 100% Guarantee: We guarantee 100% view-through rate (users cannot skip ads)
  • Under-Delivery: If contracted views not delivered, we credit the difference or extend campaign at no charge
  • Over-Delivery: We may deliver up to 10% additional views at no extra cost
  • Force Majeure: Not liable for delivery delays due to technical failures, network outages, or circumstances beyond our control

4. Ad Content Guidelines

All ads must comply with South African advertising standards and our content policy.

Prohibited Content:

  • Illegal products or services (drugs, weapons, counterfeit goods)
  • Adult content, pornography, or sexually explicit material
  • Hate speech, discrimination, or content promoting violence
  • Misleading claims or false advertising
  • Malware, phishing attempts, or malicious links
  • Content infringing copyrights or intellectual property
  • Political ads without proper disclosure and approval
  • Tobacco, alcohol ads (restricted, requires compliance proof)

Technical Requirements:

  • Video: MP4 files accepted (optional)
  • Images: JPG/PNG formats accepted (optional)
  • Audio: MP3 or audio files accepted (optional)
  • Landing Pages: Your website, WhatsApp link, social media, or any destination URL (optional)
  • All media formats are optional - use what works best for your campaign

5. Cancellation & Refund Policy

  • Before Activation: Full refund if campaign cancelled before go-live date
  • After Activation: No refunds after campaign launches
  • Partial Delivery: Refund for undelivered views if campaign terminated early by us
  • Advertiser Cancellation: Early termination by advertiser forfeits remaining budget
  • Content Violation: Campaign suspended immediately if ad violates terms; no refund issued
  • Refund Processing: Approved refunds processed within 14 business days

6. Reporting & Analytics

  • Real-time dashboard access provided within 24 hours of campaign launch
  • Metrics include: impressions, completion rate, click-through rate, device breakdown
  • Weekly email reports for Professional and Enterprise packages
  • Data retention: Analytics data stored for 12 months post-campaign
  • Export capabilities: CSV and PDF export available for all data
  • Third-party verification: Available upon request for Enterprise clients

7. Liability & Indemnification

  • ISN Free WiFi not liable for ad content accuracy or advertiser claims
  • Advertiser indemnifies us against legal claims arising from ad content
  • Maximum liability limited to campaign fees paid
  • Advertiser responsible for obtaining necessary licenses, rights, and permissions
  • We reserve right to remove ads violating terms without prior notice

8. Data Privacy & Protection

  • We comply with POPIA (Protection of Personal Information Act)
  • No personal user data shared with advertisers (anonymous analytics only)
  • User IP addresses, device IDs, and browsing history not disclosed
  • Aggregated demographic data available with user consent
  • Advertiser data kept confidential and not shared with third parties

9. Intellectual Property

  • Advertiser retains ownership of submitted ad content
  • Advertiser grants us license to display ads on our network during campaign
  • We may use anonymized campaign results in marketing materials
  • Advertiser logo/brand may be featured as client testimonial (with approval)

10. Dispute Resolution

  • Governed by laws of South Africa
  • Disputes resolved through good-faith negotiation first
  • Unresolved disputes subject to arbitration in Johannesburg
  • Legal costs borne by losing party in formal proceedings

11. Modifications to Terms

ISN Free WiFi reserves the right to update these terms at any time. Active campaigns remain under original agreed terms. New campaigns subject to current terms at time of purchase. Material changes communicated via email 30 days before taking effect.
